Terms of Service

These Terms of Service govern your use of Dispatch and related APIs. By creating an account or using the service, you agree to these terms.

1. Eligibility and Account Responsibility

  • You must have authority to bind your organization to these terms.
  • You are responsible for account credentials, API keys, and all account activity.
  • You must provide accurate account information and keep it up to date.

2. Permitted Use

You may use Dispatch to send lawful, permission-based transactional and marketing communications.

3. Prohibited Use

You may not use Dispatch to:

  • Send unsolicited bulk messages (spam) or messages to recipients who have not explicitly opted in.
  • Use purchased, scraped, rented, harvested, or otherwise non-consented recipient lists.
  • Send phishing, malware, deceptive, or unlawful content.
  • Send phishing simulations or security-awareness test campaigns without prior written consent from Dispatch.
  • Use misleading, forged, or spoofed "From", "Reply-To", or header information in any message.
  • Violate applicable law, including CAN-SPAM, CASL, GDPR, or any other anti-spam or data privacy regulation.
  • Facilitate or enable others to violate these terms or applicable law.
  • Bypass rate limits, security controls, or abuse detection mechanisms.

4. Consent and Compliance

You are responsible for obtaining and documenting explicit recipient consent prior to sending, and for honoring all unsubscribe or opt-out requests within 10 business days. You must send only to recipients who have affirmatively opted in; sending to purchased, rented, scraped, or otherwise non-consented lists is prohibited.

5. Sending Quality Requirements

To maintain platform deliverability and comply with provider policies, you must keep your sending metrics within acceptable limits:

  • Bounce rate: must remain below 2%. Accounts exceeding this threshold may be throttled or suspended.
  • Spam complaint rate: must remain below 0.1%. Accounts exceeding this threshold may be suspended without notice.
  • New accounts may be subject to a review period and reduced sending limits before production access is granted.

6. Enforcement

To protect deliverability and platform integrity, we monitor bounce rates, complaint rates, and other abuse indicators. Accounts that violate these terms or exceed quality thresholds may be throttled, suspended, or terminated. We cooperate with abuse investigations by email providers and relevant authorities.

7. Disclaimer and Liability

Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Dispatch is not liable for indirect or consequential damages.

8. Changes to Terms

We may update these terms from time to time. Continued use after updates means you accept the revised version.
